COFEPRIS New Guidance on Medical Device Registration via Equivalence and Abbreviated Pathways

COFEPRIS Publishes New Guidance on Medical Device Registration via Equivalence and Abbreviated Pathways

2 mins

In June, COFEPRIS released new guidance outlining the documentation requirements for medical device sanitary registration in Mexico through two reliance-based mechanisms: Equivalence Agreements and the Abbreviated Regulatory Pathway. The guidance is intended to improve predictability for applicants and support a more efficient review process in line with international regulatory best practices.

Background

The new guidance document, Guía de requisitos para el trámite de registro sanitario de dispositivos médicos mediante acuerdos de equivalencia y vía regulatoria abreviada, is part of Mexico’s broader regulatory modernization effort. It aims to streamline market access for medical devices that have already received authorization from recognized international regulatory authorities, while ensuring that COFEPRIS retains oversight of final registration decisions.

Two Distinct Pathways

Although both mechanisms rely on prior regulatory work from recognized authorities, they are not interchangeable. Applicants must confirm which pathway applies before preparing a submission.

  • Equivalence Agreements: Supports registration based on recognition of authorizations from three specific jurisdictions — the U.S. Food and Drug Administration (FDA), Health Canada, and Japan’s regulatory authority.
  • Abbreviated Regulatory Pathway: Relies on regulatory decisions or evaluations from a broader set of recognized Reference Regulatory Authorities. COFEPRIS retains full responsibility for the final registration decision in Mexico.

Key Submission Considerations

The guidance reinforces that a foreign market authorization alone is not sufficient for registration under either pathway. Applicants should verify that the following are aligned with the selected pathway:

  • Device configuration and intended use
  • Manufacturing site information
  • Technical documentation and performance evidence
  • Labeling aligned with Mexican requirements
  • Quality system documentation
  • Post-market surveillance information

Any differences between the device authorized abroad and the product intended for the Mexican market, including changes in configuration, indications for use, or manufacturing sites, may affect pathway eligibility or require additional justification.

  • Review the new COFEPRIS guidance before selecting a submission route.
  • Confirm whether the product qualifies under an Equivalence Agreement or the Abbreviated Regulatory Pathway.
  • Conduct an early gap assessment covering labeling, quality system documentation, risk management, post-market surveillance, and safety and performance evidence.
  • Prepare a complete technical and regulatory dossier aligned with the selected pathway.
